PRIVACY POLICY

INTRODUCTION

In compliance with Republic Act No. 10173 known as the Data Privacy Act of 2012 (DPA), the City Government of San Fernando Pampanga is committed to protect, respect and maintain the safety of your privacy. We will only use the information to provide the services you have requested from us.

This Policy is meant to help you understand what, why, and how we collect your data, how we managed and use it, and conditions under which we may disclose your information and how we secure it.

By signing the Consent Form(s) provided, you are hereby agreeing to be bound by this Policy.

WHAT ARE THE INFORMATION COLLECTED FROM YOU

We collect, acquire, or generate your personal data in many forms. These may consist of written records, photographic and video images, digital material, and even biometric records. Examples include:

  1. Information you provide us during your transaction. When you transact with us, we collect, among others:
    • Directory information (i.e., Name, Address, Gender, Birthdate, Birthplace, Telephone Numbers, Email Address, Citizenship, Education, Age, Contact Information, and other relevant information in connection with the transactions with the City Government of San Fernando Pampanga);
    • Data about your personal circumstances, such as your family background, history, marital status, government records, and other relevant circumstances and employment records; and
    • Any or all information obtained through interviews, and/or other forms of personal data collection.
  2. Information we process or generate after the collection. When applying to City Government of San Fernando Pampanga as an employee, we may also collect additional information about you, such as, but not limited to:

We may obtain these additional personal data when you:

  • Avail the City of San Fernando Pampanga’s programs, services, and initiatives
  • Transact with CSFP’s Civil Registry Office
  • Avail services of the City Social Welfare and Development Office
  • Register as Senior Citizen resident of the City and avail its services
  • Apply for employment in the City of San Fernando Pampanga
  • Apply for Kayabe Kard
  • Utilize any of the City of San Fernando Pampanga’s Business Permit and Licensing System (BPLS)
  • Carry out transaction concerning Business Permit
  • Carry out transaction concerning Real Property Tax
  • Other initiatives, programs, projects, and activities of the City of San Fernando Pampanga pursuant to Republic Act (RA) No. 7160 otherwise known as the “Local Government Code of 1991”, and other relevant and applicable laws.
  1. Unsolicited Information. There may be instances when personal information is sent to or received by us even without our prior request. In such cases, we will determine if we can legitimately keep such information. If it is not related to any of our legitimate interest, we will immediately dispose the information in a way that will safeguard your privacy. Otherwise, it will be treated in the same manner as information you provide us as confidential and secure.

Should personal data be given or submitted to the City Government on a representative basis, the corresponding authority and consent from the data subject should be present to the concerned officer/personnel for verification.

HOW WE USE YOUR INFORMATION

To the extent permitted or required by law, we use your personal data to pursue our legitimate interest as a Local Government Unit (LGU), including a variety of administrative, research, historical, and statistical purposes.

We consider the processing of your personal data for the aforementioned purposes to be necessary in the performance of our contractual obligations to you, for our compliance with a legal obligation, to protect your vitally important interests, including your life and health, for the performance of tasks we carry out in the public interest (e.g., public order, public safety, etc.) or for the legitimate interests of the City Government of San Fernando Pampanga or a third party, among others. We understand that the DPA imposes stricter rules for processing sensitive personal information and privileged information, and we are fully committed to abiding by those rules.

If we require your consent for any specific use of your personal data, we will collect it at the appropriate time.

Please note that we will not subject your personal data to any automated decision-making process without your prior consent.

HOW WE PROTECT YOUR DATA

The Data Privacy of the City Government of San Fernando Pampanga is being managed by the registered Data Protection Officer, Atty. Jose Elmer Y. Teodoro (currently the City Legal Officer of the Local Government Unit of City of San Fernando Pampanga). The Data Protection Officer, who is being assisted by the Compliance Officer for Privacy (COP) of each office/department, shall oversee the compliance of the LGU with the Data Privacy Act, its IRR, and other related policies, including the conduct of a Privacy Impact Assessment (PIA), implementation of security measures, security incident and data breach protocol, and the inquiry and complaints procedure.

Personal data in the custody of the LGU may be in digital/electronic format and paper-based/physical format. All personal data being processed by the LGU shall be stored in a data room, where paper-based documents are kept in locked filing cabinets while the digital/electronic files are stored in secured server managed by the City Information and Communications Technology Office’s server administrator/s and only the authorized personnel have the access of the server with the level of access permission.

RETENTION AND DISPOSAL

Data gathered shall be retained only for a certain period necessary to complete a specific transaction in accordance with the General Records Disposition Schedule (GRDS) issued by the National Archives of the Philippines (NAP), or as required under any obligation or by any law, rule, or regulation.

Thereafter, digital data shall be anonymized, and physical copies, if any, shall be subject for disposal by means of selling, by landfill, shredding or by any other way of destroying them.

Accordingly, the City Government of San Fernando Pampanga, through the City General Services Office – Records Management Division (CGSO-RMD) shall request for authority to dispose records to the National Archives of the Philippines until such time it was appraised and evaluated by Records Management Analyst and approved by the Executive Director.

HOW WE SOLVE BREACH AND SECURITY INCIDENTS

The resolution of any data breach and security incident shall be resolved by the Data Privacy Compliance Committee, led by the Data Protection Officer, in coordination with the concerned offices and departments of the City Government, in accordance with the duly issued Privacy Manual of the City of San Fernando Pampanga. WHAT ARE YOUR RIGHTS AS DATA SUBJECT

As stipulated in the Data Privacy Act of 2012, you, as the data subject, accorded certain rights which may invoke and enforce against data controllers or processors, and which the latter are duty-bound to observe and respect the right to access your own information.

  1. Right to be informed – means that the subject has the right to know when his/her personal data shall be or have been processed. Collection and processing of data without the data subject’s knowledge and explicit consent is made unlawful, and entities in possession of personal data is obligated to inform the data subject of any breaches or compromises in their data;
  2. Right to access – involves being able to compel any entity possessing any personal data to provide the data subject with a description of such data in its possession, as well as the purposes for which they are to be or being processed;
  3. Right to object – requires that the consent of the data subject be secured in the collecting and processing of his or her data. It grants the data subject the choice of refusing to consent, as well as the choice to withdraw consent, as regards collection and processing;
  4. Right to erasure or blocking – allows the data subject to suspend, withdraw or order the blocking, removal, destruction of his/her personal information from the personal information controller’s filing system upon discovery and substantial proof that the personal information are incomplete, outdated, false, unlawfully obtained, used for unauthorized purposes or no longer necessary for the purposes for which they are collected;
  5. Right to rectify – allows the data subject to dispute any inaccuracy or error in the personal information processed, and to have the personal information controller correct it immediately. In line with this, the personal information controller must ensure that the new and the retracted information will be accessible, and that third parties who received the erroneous data will be informed, upon the request of the data subject;
  6. Right to data portability – enables the data subject to obtain and electronically move, copy, or transfer personal information;
  7. Right to file a complaint – affords a remedy to any data subject who feels that his/her personal information has been misused, maliciously disclosed, or improperly disposed or in case of any violation of his/her data privacy rights.
  8. Right to damages – entitles the aggrieved data subject to be indemnified for any damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained or unauthorized use of his/her personal information.

We recognize these rights with respect to your personal data, as provided by the DPA. CHANGES IN THE PRIVACY POLICY/NOTICE

We may, from time to time, make changes to this Privacy Policy. On such occasions, we will let you know through our website/s and, when permissible, other means of communication. Any modification is effective immediately upon posting on the website.
